Permit

Pool and SPA


A permit is required for any indoor or outdoor pool (permanent or temporary) designed for swimming, bathing or other water-based entertainment and having a depth of at least 60 cm.

Please note:

  • Applications are reviewed on a first-come, first-served basis; 
  • Please allow 10 working days for a reply; 
  • It may take up to 60 days to obtain your permit;
  • That the analysis of the application, as well as the 60-day delay, begins only when the application submitted is declared valid and complete by the municipal officer; 
  • That an application received without the necessary documents and/or information will be declared incomplete and refused.

What you need to know before obtaining this permit

  • The cost of the permit is $65. The cost of renewing a permit is set at 50% of the initial cost.
  • A $540 compliance bond is also required.
  • Work must begin within six (6) months of the building permit being issued.
  • If natural environments are present, a professional firm must survey them and then identify the delimitation of the natural high-water line on the site. This line will then be surveyed by the land surveyor and recorded on the site plan.

Spa

  • A rigid removable cover equipped with a passive safety device must prevent access outside periods of use.

Above-ground pool

  • Terrace attached to the residence: The enclosure must prevent direct access between the house and the pool, as well as between the yard and the pool.
  • Platform / patio: The enclosure must prevent direct access to the pool from the outside yard.
  • Ladder: Provide a door to prevent access.

In-ground pool

  • A fence must surround the entire pool to prevent access from the outside yard and from the residence.

List of documents to be supplied

  • Site plan, to scale with dimensions, illustrating :
    • Location of existing buildings; 
    • The location and distances of the pool, fence, patio, terrace or porch and their staircases and railings;
    • Location of pool-related equipment;
    • Location of septic systems and well;
    • Location of trees and wooded areas;
    • Location of any watercourses, wetlands, etc. 
  • Plans, sketches or brochures of the pool, fence, enclosure, patio, terrace or gallery and details of railings
  • Fence/enclosure details: location of gates and details of locking mechanism (location and height)
  • Location of water discharge
  • Geotechnical study (if required)
  • Characterization study by ABQ member biologist (if required)
